The State Duma approved amendments on expelling foreigners for human rights violations

The State Duma (State Duma) adopted amendments to the Administrative Code of the Russian Federation in the third reading, according to which foreign citizens and stateless persons will be able to be expelled from Russia for discrimination, violation of certain human rights and disobedience to the legitimate demands of border guards. The relevant document was published on the Internet portal for legislative support on July 21.

As specified on the website of the State Duma, thanks to the amendments, the number of articles of the Administrative Code for which expulsion from the country is envisaged will more than double and amount to 45.

"If a migrant does not obey police officers or starts to sort things out with a border guard at the border, this is enough for the migrant to be expelled," said Vyacheslav Volodin, chairman of the lower house of parliament.

For violating the equality of human rights and freedoms, depending on gender, race, nationality, language, origin, property and official status, place of residence, attitude to religion, beliefs and membership in public associations, foreigners will face a fine from 10 thousand to 30 thousand rubles with administrative expulsion.

Expulsion is also provided for violations of the right to freedom of conscience and religion. The fine for foreign citizens and stateless persons will range from 30,000 to 50,000 rubles.

For disobeying the lawful order of an FSB officer, including border authorities, foreign citizens will be fined from 5,000 to 7,000 rubles with expulsion from the country.

Foreigners will also be able to be expelled for obstructing meetings, rallies, demonstrations, marches and picketing. Responsibility is also provided for forcing a person to participate in a public event or to refuse it.

The amendments introduce expulsion for violating the procedure for organizing and holding public events, illegal involvement of minors in such actions, as well as actions that interfere with the operation of life support facilities, transport or social infrastructure, communications and citizens' access to residential premises.

The measure will also be applied for a number of other administrative offenses, including violations of the rules of operation of foreign and international non-profit organizations, participation in the work of undesirable organizations, illegal use of weapons and individual violations of the rules of their circulation.

Foreigners who have been subject to compulsory administrative expulsion by the authorized body will be able to submit a request for review of the resolution to this body. Such a request must be considered immediately. The law will enter into force 90 days after its official publication.

Earlier that day, the State Duma adopted in the third reading a law banning foreigners with outstanding or outstanding criminal records from obtaining Russian citizenship and the right to reside in the country. The restrictions apply to foreigners convicted of crimes both in Russia and abroad. An act committed abroad must be recognized as a crime in accordance with the federal legislation of the Russian Federation.

The presence of an outstanding or outstanding criminal record will be the basis for refusing to issue a temporary residence permit, a temporary residence permit for educational purposes and a residence permit. A similar restriction is imposed for obtaining Russian citizenship. To apply for documents, a foreigner will need to provide a certificate of absence or criminal record.
