The rules of overtime work will change in Russia from September 1
Starting from September 1, 2026, the rules for attracting employees to overtime work will change in Russia. At the same time, the statement that the annual overtime limit is increased to 240 hours does not fully correspond to the content of the law. Lawyer Mark Varshaver told about this in a conversation with Izvestia.
As a general rule, the maximum duration of overtime is still 120 hours per year. The possibility to increase this limit to 240 hours is provided only as an exception and subject to the conditions directly established by the Labor Code of the Russian Federation.
"The law does not set a new normal limit. It retains 120 hours as the basic protective standard and allows you to exceed its limit only if there is a collective basis, individual consent of the employee, established procedures, medical guarantees and increased pay," explained Varshaver.
An increase in the annual limit is possible if there is a collective agreement or an industry agreement and the written consent of a particular employee. Thus, 240 hours does not become the total overtime limit for all employees.
The changes also affect overtime pay, the length of overtime during the day, and medical guarantees for employees who work overtime for more than 120 hours per year. Prohibitions and additional restrictions remain in place for certain categories of employees.
