In Russia, the apartment owner can be transferred to pay for water according to the standard in the absence, malfunction or loss of the meter, as well as after the expiration of its verification period. Ivan Krasnov, a lawyer and real estate specialist, told Izvestia about this on July 20.
The calculation depends on the reason why the readings of the device are no longer taken into account. In case of meter malfunction or overdue verification, the first three billing periods are usually charged according to the average monthly consumption, and from the fourth month — according to the standard with an increasing coefficient. If the device has worked for less than three months and the average volume cannot be determined, the standard can be applied immediately.
"A separate reason is the termination of the transmission of testimony. In this case, the first three months also use the average monthly consumption, and then switch to the standard. But the increasing coefficient is not applied only because of the non-transmission of readings," Krasnov said.
After transmitting the relevant data, the contractor must check the readings and adjust the calculation. If there is no counter, if it is technically possible to install it, the fee is immediately charged according to the standard with an increasing coefficient.
In case of erroneous charges, the owner should request a check of the calculation and recalculation, and in case of refusal, contact the housing inspectorate or the court. In case of interruptions with hot water or heating, it is necessary to register an appeal with the emergency dispatch service and receive an inspection report.
If the management company has not recorded a violation, residents can draw up an act on their own, attaching photographs, videos and other confirmations, the lawyer concluded.
Vladimir Koshelev, first deputy chairman of the State Duma Committee on Construction and Housing and Communal Services, said on May 19 that after planned hot water shutdowns, bills for housing and communal services should be at least a third lower. It was noted that during the planned outages for two weeks, the recalculation will already be included in the tariff and calculated automatically.
