The oncologist assessed the likelihood of Lercek's participation in court sessions
Candidate of Medical Sciences, oncologist Evgeny Cheremushkin commented on Friday, July 10, on the possibility of blogger Lerchek (real name — Valeria Chekalin), who was diagnosed with grade IV stomach cancer, participating in court hearings.
The specialist explained that here we are talking not only about the physical, but also about the legal aspect, which is strictly regulated.
"These are legal issues, where everything is described on each point. Legal capacity is dictated on the basis of documents submitted by doctors, that she is oriented in space, time and in everything that is happening around her. Naturally, no one will carry her on a stretcher, but if she is sufficiently social and physically active, then, of course, they will summon her to court," he said in an interview with aif.ru .
Cheremushkin added that the logic of the court is simple: if a person can walk, go to a cafe or play sports, then he is able to attend the hearings. At the same time, the final decision always remains with the attending physicians and judicial authorities, who evaluate each specific case on the basis of official documents, he said.
The court hearing to reopen the Lercek criminal case did not take place on July 10, and the hearing was postponed to Monday, July 13. Her lawyer stated that the defendant did not appear in court because she is undergoing medical treatment, writes "Moscow 24". At the hearing on July 10, the issue of the blogger's withdrawal of more than 250 million rubles to the UAE was to be considered.
On the same day, it became known that Lercek was being treated at the Blokhin National Research Medical Center of Oncology and would not be able to attend the court hearing, where the hearings of her criminal case were to resume, IA Regnum reports. The court also had to consider changing Chekalina's place of residence, since the lease period for the house, the address of which she indicated when choosing a preventive measure in the form of a ban on certain actions, expired, according to the website. kp.ru .
Chekalina's criminal case on the withdrawal of more than 250 million rubles to the UAE under forged documents was transferred to another judge on June 19. Prior to that, the prosecutor's office applied to the metropolitan court with a request to conduct a second forensic medical examination of Lerchek. The reason for the appeal was publications on social networks, where the blogger demonstrated active sports activities during the days of undergoing chemotherapy.
The day before, Lercek's lover Luis Squicciarini announced that the blogger had completed her eighth course of chemotherapy after being diagnosed with stage IV stomach cancer.
