The lawyer named the conditions for using correspondence as evidence in court.
Online correspondence can be evidence in court if its contents and the persons involved are legally established. This was announced on July 5 by Vladimir Kondratiev, Candidate of Law, Director of the VGUU College.
"Our judicial practice confirms that correspondence via e-mail, messengers and social networks are full-fledged evidence. If we look at the Civil Code with you, it says that a written contract is equivalent to an electronic contract, but two conditions must be met: so that we can establish the content of this correspondence and the person from whom it originates," he said.
Kondratiev explained to RIA Novosti that in order to involve correspondence in court proceedings, it is necessary to notarize the messages, but this is a rather expensive procedure. According to him, work is currently underway to exclude this stage in order to speed up the court's involvement of evidence in the case.
The lawyer also pointed out that electronic evidence is more reliable than physical media, as it leaves noticeable digital traces. According to him, if the proof is an e-mail correspondence, then the data will be stored in at least four places: at the sender, the recipient, on the sender's server and on the recipient's server. All this eliminates the possibility of loss or destruction of evidence, as in the case of paper documents.
Ilya Rusyaev, a lawyer and founder of the Rusyaev Club business community, told Izvestia on May 5 that the government had approved a set of preventive measures among young people until 2030, which includes monitoring open activity on social networks to identify prohibited information. According to Rusyaev, the zone of acceptable monitoring includes open posts, comments, reposts, public communities and account IDs. Personal correspondence and private profiles are not included in this outline.
