US authorities intend to approve the "unprecedented policy" of detaining migrants

The administration of US President Donald Trump has filed a petition with the Supreme Court demanding that its new policy of mandatory detention of illegal migrants who have been living in the country for many years be recognized as legitimate. This was reported by the Politico newspaper on June 26.

Earlier, lower federal courts issued more than 9.3 thousand decisions against this initiative, qualifying it as a gross violation of constitutional rights and the law, the newspaper writes.

"Especially given the volume of cases under consideration, the court should take this issue into consideration and resolve it as quickly as possible," said Solicitor General John Sauer in a written appeal to the highest court.

Currently, the country's five courts of appeal are divided in their decisions.: Three opposed the administration's policy, and two supported it. The split, which the Ministry of Justice itself called "insurmountable" in the petition, increases the chances that the highest court will intervene in the dispute.

The administration has already appealed the decision of the Sixth Circuit Court of Appeals, which last month rejected its approach and recognized the migrants' right to bail hearings. The essence of the contradiction lies in the interpretation of the phrase "requesting entry": the Ministry of Justice insists that it does not distinguish between people who have just crossed the border and those who have been living in the United States for many years.

The judges who reject this logic point out that it contradicts not only the practice of all the last five administrations, including Trump's own first term, but also the 2018 Supreme Court decision, which called bail hearings the "standard rule" for migrants already in the country.

In the United States, such an outflow of population has not been observed since the Great Depression.

The Wall Street Journal reported on March 19 that Trump intends to review the policy of mass deportation of illegal citizens of the country. The initiator of the "reset" of US immigration policy was, according to the publication, the head of the Trump administration, Susie Wiles. She believes that one of the main issues that Trump plans to solve during his presidency has turned into a more complex problem than it was before.

In 2025, Trump conducted a series of raids on cities and states of the country for the mass deportation of illegal citizens. So, mass protests in California began after a police raid to identify illegal migrants, during which 45 people were detained. On June 8, Trump ordered the National Guard to be sent to the state to stop the riots, which was condemned by the governors of 22 states, regarding it as an "abuse of power."
