Employees who combine professions, expand service areas, increase the amount of work, or perform the duties of a temporarily absent colleague without being released from their main activities are eligible to receive additional payments. This was announced on June 9 by State Duma Deputy Dmitry Svishchev.
"According to Article 151 of the Labor Code of the Russian Federation, when combining professions, expanding service areas, increasing the amount of work or performing the duties of a temporarily absent employee without being released from his main job, a citizen is entitled to an additional payment," Svishchev said in an interview with RIA Novosti.
According to the parliamentarian, the specific amount of such an additional payment is determined by agreement between the employee and the employer, taking into account the content and amount of additional workload. He stressed that this amount should not be symbolic or insignificant, but should adequately reflect the amount of work performed. If the employer offers minimal compensation, the employee has every right to refuse such a combination, and this will not be considered a violation of labor discipline.
Svishchev also noted that oral agreements in this case have no legal force. To formalize the combination, it is necessary to follow a certain algorithm of actions.: first, obtain the written consent of the employee to perform additional duties, then conclude an additional agreement to the employment contract, which will specify the terms, nature of the work and the amount of additional payment, and finally wait for the issuance of the relevant order.
Svishchev also recalled the existence of two fundamentally different ways of replacing a vacationer — combination and temporary transfer. In the first case, the employee performs duties in another position in parallel with his main job and receives an additional payment to his salary for this, in the second case, he completely moves to the position of an absent colleague, relieving himself of his former functions. In this case, he is paid a salary for a new position. If this salary turns out to be lower than his previous one, the employer may, by agreement, pay the difference.
Olga Leonova, PhD in Law, Associate Professor of the Department of State and Municipal Finance at the Georgy Plekhanov Russian University of Economics, said on June 9 that employees in Russia have the right to refuse to perform their duties in the summer if the office temperature exceeds 28 degrees. In such cases, the employee has the right to suspend his activities, having previously notified the management in writing.
