The growth of Sosnovsky hogweed on a plot of land is no longer a reason for the seizure of land due to its recognition as unused. Vladimir Koshelev, first deputy chairman of the State Duma Committee on Construction and Housing and Communal Services, recalled this on May 28.
"Previously, the formal approach made it possible to interpret hogweed foci as a sign of complete desolation of the site. Now they have abandoned the practice, when one biological factor threatened people with the loss of land. The authorities are obliged to assess the totality of circumstances, and not to make a verdict on one plant," he told TASS.
Currently, the mere fact of the growth of this plant cannot be the reason for the seizure of land from the owner. As the parliamentarian added, the new rules remove unnecessary formal pressure, while maintaining the requirements for land development.
Olesya Slezkina, a lawyer at the Moscow City Bar Association, a member of the Sinelshchikov and Partners Bar Association, said on March 30 that control over the presence of hogweed on land plots can be carried out at the request of citizens, as part of routine inspections, as well as using unmanned monitoring systems (UAS). According to the expert, during the inspections, employees of the Rosselkhoznadzor, Rosreestr or municipal authorities inspect the territory, record violations and issue the results in the form of an act.
