The State Duma rejected the bill on CTP regression to the perpetrators of the accident

At the plenary session on May 27, the State Duma rejected a bill obliging insurance companies to recover funds paid for CTP from the perpetrators of an accident if the accident occurred under aggravating circumstances. The document is published on the website of the lower house of Parliament.

The bill provides that if the violator was drunk, drove without a license, fled the scene of an accident, etc., insurance companies are required to present regressive claims to this person — that is, first to compensate the injured driver, and then through the court to claim these funds from the culprit of the accident, even if he has a CTP policy.

In addition, the draft law was planned to establish the obligation of the Bank of Russia to publish statistical information on the level of recourse claims in the Russian Federation as a whole on the official website; to introduce the obligation of insurers to send recourse claims for voluntary payment and make it possible to pay them through the e-government infrastructure; to introduce the use of writ proceedings when collecting recourse claims for CTP from certain categories of persons.

The inter-factional bill was submitted to the State Duma by the head of the Committee on Labor, Social Policy and Veterans Affairs Yaroslav Nilov in February this year. The parliamentarian emphasized that CTP regression is a current practice, but today insurers rarely use it, as a result of which companies shift their costs to bona fide drivers by increasing tariffs.

In concluding on the bill, the State Duma Committee on State Construction and Legislation, among other things, pointed out that the key proposal of the proposed initiative — the imperative of the insurer's recourse claim under the CTP contract to the person who caused the harm — is in direct contradiction with the fundamental principles of civil law. It was noted that the draft law obliges the insurer to act in cases of intent, intoxication or abandonment of the accident site of the harm-doer, as a result of which the harm-doers find themselves in different legal positions.

Insurance companies will be required to file lawsuits against violators in cases of accidents with aggravating circumstances.

Earlier in the day, it was reported that the State Duma rejected a bill that proposed to impose administrative liability on officials for illegal fines for car owners imposed with the help of cameras.
