Kazakhstan will not enforce the decision on Naftogaz's lawsuit against Gazprom
The Kazakh authorities will not enforce the decision of the Astana International Financial Center (AIFC) court on the claim of the Ukrainian energy company Naftogaz to recover $1.4 billion from Russian Gazprom. This was announced on May 25 by the head of the Ministry of Justice of the Republic Yerlan Sarsembayev.
The AIFC Court is an international commercial court for civil and commercial disputes between AIFC participants and parties that have agreed to recognize its jurisdiction.
"The Republic of Kazakhstan will not become a transit platform for the execution of decisions that have no legal connection with it. Thus, the legal mechanisms of the republic do not provide for the consideration of disputes unrelated to its jurisdiction, and therefore the decision of the AIFC court under consideration will not be executed on the territory of Kazakhstan," the portal quotes Sarsembayev as saying. Sarsembayev also noted that the case "lacks the basic elements of a jurisdictional relationship with the AIFC," since Gazprom has nothing to do with the activities and law of the financial institution.
