Sofya Lukinova, head of the legal department of VMT Consult, said that the introduction of any injections without parental consent is a gross violation of the law. According to No. 323-FZ "On the Basics of Protecting the Health of Citizens in the Russian Federation," any medical intervention is allowed only after receiving written permission from the child's legal representatives.
The perpetrators may face liability under several articles, including intentional harm to health and illegal provision of medical services if the employee does not have a specialized education. Officials who have committed such a thing may be held liable under the article on negligence. There are also administrative penalties for violating students' rights.
"If the fact of injecting anything without consent, and even more so notifying parents to young children, is confirmed, it will be a gross violation of the law," the lawyer said.
Psychological trauma
Practical psychologist Tatiana Goldman emphasized that for a child, the caregiver is a significant adult, and threats of pain undermine the basic sense of security. The consequences of such treatment are anxiety, sleep disorders, aggression or isolation. Such changes in behavior are signals of psychological distress, not whims.
Such negative experiences can form persistent phobias in front of doctors and unfamiliar adults for years to come. Children often remain silent about what is happening because of the high authority of an adult, fear of parental reaction, or inability to describe their difficult experiences in words.
"The threat of a painful injection as a punishment undermines the basic sense of security: a place that should be associated with play and development turns into a source of fear," the expert explained.
Recommendations to parents
According to the lawyer, parents need to collect evidence in order to go to court.: medical certificates with traces of injections, recordings from cameras and witness statements. At the same time, time is important, since camera recordings can be deleted, and traces of physical interference can be delayed.
The psychologist, in turn, recommended not discussing the details of the incident in front of children and contacting a pediatric specialist at the first sign of an anxiety disorder. It is important to build trusting relationships in advance so that the child is not afraid to talk about any situation.
