The employer has the right to require an employee to observe the business style of clothing, if such rules are fixed in the local acts of the company and the employee has been familiarized with them. The lawyer of the Moscow Region Bar Association, Yana Kovalevskaya, told Izvestia about this on May 21.

"If it is prescribed, and the person has agreed, agreed to comply with these conditions, then he must comply with them," she said.

According to the expert, in some organizations, the requirements for appearance remain strict even in hot weather. For example, employees may be required to come to the office in business clothes, closed shoes and without elements of a summer wardrobe, if this is provided for by internal rules.

Kovalevskaya explained that the local act of the employer is an internal document of a specific organization. It may specify the staffing table, bonus procedure, work schedule, document management rules, as well as requirements for the appearance of employees. Such norms are usually found in office and business companies.

If the employee was not informed in advance about the ban on shorts, T-shirts or sandals, the employer's requirement may be controversial. However, if there is a local act and confirmation of familiarization, coming to work in an inappropriate manner may be considered a violation of internal rules.

An act is drawn up to fix the violation. It is signed by employees who witnessed non-compliance with the dress code. At the same time, the lawyer noted, the law does not establish certain categories of employees who may not comply with appearance requirements for health reasons, but in such cases the human factor may be taken into account.
