FAS accused Dymovsk sausage production of unfair competition
The Federal Antimonopoly Service (FAS) of Russia has recognized the actions of the Dymovsky sausage factory as unfair competition. This was reported on May 8 in the press service of the department.
It was clarified that the company prohibited competitors from using the name of the sausage "Festive" after it received the exclusive right to the trademark "Festive" in 2023 and began to prevent the use of the controversial designation by other manufacturers.
"The actions of the Dymovsky sausage production could be aimed at obtaining unreasonable advantages over competitors who sold sausage products with the same name before registering the disputed trademark," the FAS added.
The Agency will monitor the execution of the issued order.
On December 29, the FAS announced that it had initiated proceedings following an appeal from the Ostankino Meat Processing Plant against Dymov Sausage Production LLC due to a possible violation of competition law.
It was clarified that the company has been producing and selling sausage products under the Ostankino brand since 1993, including the Festive sausage since 2001. Over time, this designation began to be used by other manufacturers, whose products were widely sold and were popular with customers.
In 2023, Dymov Sausage Production registered the right to the trademark "Festive", and then the company began to sue entrepreneurs who sold sausage with that name. After the appeal, the FAS opened a case on grounds of violation of the Law on Protection of Competition.
