A gift certificate is considered a pre-payment for the product, so the consumer has the right to refund the money for it. This was reported on May 7 in the press service of Rospotrebnadzor.

"The question often arises what to do if, for certain reasons, it was not possible to use a gift certificate. Rospotrebnadzor informs: a gift card in the legal sense is considered as an advance payment for goods that can be returned," RIA Novosti quoted the press service as saying.

The agency clarified that if the seller introduced rules that contradict the law, the buyer has the right to file a claim and demand a refund.

In addition, the buyer can complain to Rospotrebnadzor or file a lawsuit in court. In this case, he has the right to demand a refund, payment of a penalty, compensation for moral damage, as well as a fine in the amount of 50% of the amount awarded, if his demands were not fulfilled voluntarily.

Alexander Khaminsky, head of the Law Enforcement Center in Moscow and the Moscow Region, said on March 10 that many Russians had received gift cards and marketplace certificates during the holidays, but sometimes they could not use them. According to the lawyer, there are often situations when the certificate cannot be activated because the application says that the code has already been used. In this case, we may be talking about fraud: attackers can select codes using special generators or spy on them before selling the card.
