The State Duma proposed to protect drivers working on expensive equipment
A bill has been submitted to the State Duma aimed at protecting workers who manage expensive equipment. The goal of the initiative is to prevent people from falling into a "debt pit" in case of accidents or breakdowns, Yaroslav Nilov, one of the authors of the project, chairman of the State Duma Committee on Labor, Social Policy and Veterans Affairs, said in his Telegram channel on April 28. The bill is published on the website of the lower house of Parliament.
He explained that the cost of cars or complex industrial equipment is often several times higher than the annual income of an employee, therefore, in the event of an accident, when the driver is the culprit, the employer, as a rule, seeks damages from the employee himself. This leads to large debts for citizens.
"In case of damage to the property of third parties, insurance companies that make payments under casco or CTP contracts often use the right of recourse against the direct culprit, the employee. This situation leads to unbearable debt obligations for citizens, which entails the risk of destabilizing their social situation," the explanatory note says.
The bill proposes the introduction of an occupational risk insurance mechanism. According to the idea, employers will be required to insure the liability of employees working with property from the "expensive" category. Thus, financial obligations in case of damage are shifted from an individual to insurance institutions, Nilov noted.
In accordance with the current labor legislation (art. 241 of the Labor Code of the Russian Federation), an employee is financially responsible for the damage caused within the limits of his average monthly earnings, except in cases provided for in Articles 242 and 243 of the Labor Code of the Russian Federation, when full financial responsibility occurs.
At the plenary session on April 21, the State Duma adopted in the second and third readings a bill on amendments to the Administrative Code of the Russian Federation, which stipulates the consolidation of the right to copy case materials of administrative proceedings for persons in respect of whom they are conducted, as well as for victims, defenders and representatives of participants in such cases. The innovation should first be appreciated by motorists who regularly face the impossibility of copying texts, audio and video materials related to administrative cases in which they participate without court decisions.
