UK to pay damages for child's burns due to battery breakout in Yakutia
In Yakutia, the Gubinsky Housing and Communal Services management company will pay more than 280 thousand rubles in favor of a family whose child suffered due to a radiator rupture. The Supreme Court of Yakutia upheld the decision of the lower court.
According to IA YakutiaMedia, in Yakutsk, in an apartment building on Dzerzhinsky Street, the tightness of a plug in a cast-iron radiator was broken. Boiling water gushed into the kitchen, the child suffered second-degree burns, the kitchen and furniture were damaged.
The reasons for the incident were investigated by a commission with the participation of representatives of the Capital Repair Fund and several criminal codes. Experts have recorded a rupture of the water intake valve on the radiator cap. The heating pipes were not changed during the renovation of the apartment.
The prosecutor demanded to recover damages and compensation for moral damage, medical expenses, assessment and a fine. The Gubinsky Housing and Communal Services Management Company disagreed, saying that the responsibility lies with the Capital Repair Fund. However, the court found that the maintenance of common property, including the heating system, is the responsibility of the Criminal Code.
The Supreme Court of the Republic rejected the appeal of the Criminal Code.
Earlier it was reported that a resident of Blagoveshchensk won in court over the NGO "Fund for Capital Repairs of apartment buildings in the Amur region." The FKR is obliged to compensate the damage to the landlady of the apartment building in Yuzhny Lane from the flooding of housing that occurred during repairs on the roof of the house. The court ordered an independent expert examination. According to its results, the damage was estimated at 400 thousand rubles.
