Knocking carpets off the balcony is not directly prohibited by law, however, in some cases such actions may be recognized as an administrative offense. Judicial lawyer Lyubava Trofimova told Izvestia about this on April 10.
"The Administrative Code of the Russian Federation has not established a direct ban on the commission of actions to knock dust out of carpets from the balcony. However, such actions can be qualified as an administrative offense, the responsibility for which is provided for in Article 6.4 of the Administrative Code of the Russian Federation if they entailed a violation of sanitary and epidemiological requirements for the operation of residential premises," the expert noted.
The specialist stressed that in order to be held accountable, it is necessary to record the fact of a violation. In particular, you can use a photo or video recording, which should show the address, floor, balcony and a spreading cloud of dust.
In addition, witness statements from neighbors may be taken into account, as well as acts drawn up by the management company or the HOA. After that, the injured party has the right to file a complaint with Rospotrebnadzor.
If administrative measures fail and violations continue, legal protection is possible. In this case, it is possible to demand a ban on such actions, compensation for moral damage or damages if property was damaged, Trofimova concluded.

According to the expert, in such situations, the first step is to try to solve the problem peacefully.
