Residents can challenge any changes to the housing and communal services receipt that affect the amount of the total amount by sending a written request to the management company (CC) with a request to verify the legality of the charges. This was announced on March 26 by Stanislav Guzhov, Associate Professor of the Faculty of Management at the Institute of Management of the Presidential Academy.
"Residents have the right to challenge any new line in the receipt if it affects the amount of payment for housing or utilities," he said in an interview with RIA Novosti.
Guzhov stressed that the management company or HOA is required to provide information on the composition of the fee, methods of its calculation, as well as to notify in advance of the increase in charges, usually no later than 30 days before the invoice is issued. If the explanations from the management organization are not enough, the tenants can send a written request to verify the legality of the charges and provide the relevant documents. In case of violations, the management company is obliged to check and correct the errors.
It clarifies that if the issue cannot be resolved at the level of the Criminal Code, residents can contact the State Housing Inspectorate, which deals with complaints about the actions of management organizations. You can also submit a question to the general meeting of owners to submit a collective appeal. If pre-trial measures do not lead to a result, residents can challenge the charges in court. If there are violations, the court has the right to recognize them as illegal and oblige them to recalculate.
