The lawyer warned about fines for unauthorized installation of radiators
Unauthorized replacement or installation of radiators in an apartment can result in a fine and additional costs for the owner. Ilya Vasilchuk, a judicial lawyer and an expert on the security of electronic transactions and real estate transactions, told Izvestia on March 19.
"The fine for unauthorized installation of radiators ranges from 1 thousand to 1.5 thousand rubles and is provided for in Article 7.21 of the Administrative Code of the Russian Federation. We are talking about a violation of the rules for the use of residential premises, including interference with the communal heating system," the expert explained.
According to him, such work is considered a violation because it can affect the functioning of the entire heating system in an apartment building. This can lead to an uneven distribution of heat between apartments and create a risk of emergency situations. This is especially true in cases where radiators belong to common property, for example, if they are not equipped with shut-off valves or serve several rooms.
Vasilchuk clarified that in the presence of shut-off valves, the radiator can be considered the property of the apartment owner, and in some cases its replacement is allowed without approval. However, even in such a situation, any changes affecting the operation of the entire system may entail liability.
The expert noted that in order to carry out work without violations, it is necessary to follow the established procedure. In particular, in the absence of shut-off valves, coordination with the management company is required and, if necessary, obtaining permission from local governments. After completion of the work, an act of commissioning is issued.
He also stressed that uncoordinated changes can lead to serious consequences.
"If a leak occurs due to an unauthorized installation and the neighbors' property is damaged, the owner will be obliged to repair the damage and restore the heating system at his own expense," Vasilchuk added.
According to him, compliance with technical requirements and preliminary approval of work make it possible to avoid not only fines, but also more significant financial risks.
On the same day, Ilya Rusyaev, a lawyer and founder of the Rusyaev Club business community, said that summer residents could receive a fine of up to 50,000 rubles for improper incineration of garbage. According to Article 20.4 of the Administrative Code of the Russian Federation, a citizen faces a warning or a fine of 5,000 to 15,000 rubles for violating fire safety requirements. If a fire has occurred due to a violation and someone else's property has been damaged or minor or moderate damage has been caused, the fine is up to 50 thousand rubles.
