Ivan Melnikov, Vice President of the Russian division of the International Committee for the Protection of Human Rights, told which plants and mushrooms are considered a crime to disrupt.

In an interview with Radio 1 on Friday, March 13, the expert recalled that under Article 260.1 of the Criminal Code of the Russian Federation, serious punishment is provided for the disruption and destruction of especially valuable plants listed in the Red Book, up to imprisonment.

He explained that it is important to understand which plant is in front of a person. Especially valuable, for example, are lilies of the valley and snowdrops. The list of rare species also includes some mushrooms: crumbling fly agaric, fragrant cobweb, oyster mushroom, summer truffle, floccose mushroom, chased mushroom and root-loving tinder. Criminal liability may arise if such plants or fungi are plucked from a specially protected area — in a nature reserve or national park — or are collected en masse for subsequent sale.

Melnikov noted that the very fact of collecting for the purpose of sale can already be considered a crime. According to him, a real term is also possible for the illegal collection of ginseng or Rhodiola rosea. In addition, large fines are provided for such violations — up to 3 million rubles.

Lawyer Ilya Rusyaev on March 12, in an interview with RT, explained which spring flowers face responsibility for collecting. The federal list of protected species includes, for example, Voronov's snowdrop, broadleaf snowdrop, several types of lumbago (sleep grass), a number of species of iris and grouse. At the regional level, the list is even broader: May lily of the valley, liverwort, honeydew, anemone and crested. Rusyaev added that the sale of red book flowers near roads and markets is also punishable. Violations are recorded by Rosprirodnadzor inspectors and employees of environmental services, NSN clarifies. If we are talking about a large shipment or a systematic collection for the purpose of sale, the case may turn into a criminal case. 360.ru .

Sofya Lukinova, head of the legal department of VMT Consult, told Izvestia on March 11 that for collecting a rare plant in the forest, you can get a fine from 2.5 thousand to 5 thousand rubles. For organizations, the fine can be up to 1 million rubles (art. 8.35 of the Administrative Code of the Russian Federation), and officials can be fined from 15,000 to 20,000 rubles. These measures apply to those who plucked the plant accidentally, without intent.

In February, lawyer Valentina Kudelina in an interview with the website kp.ru She listed important resources for finding a list of dangerous plants. According to her, it is available in the "Land Relations" or "Ecology" section on the portals of public services in the region or the official websites of regional governments, the Rosselkhoznadzor or the Ministry of Natural Resources of the constituent entity of the Russian Federation.
