Chairman of the State Duma Committee on Construction and Housing and Communal Services Sergey Pakhomov on Tuesday, March 3, commented on the position of the Supreme Court on disputes between residents and management organizations, voiced at the annual meeting of judges.
"The signal for judicial practice is very clear: if a service is rendered poorly, it is the managing organization, as a professional contractor, that must prove that the obligations are fulfilled properly," Pakhomov said.
According to him, this is fundamentally important for people, since owners often do not have access to primary documents, estimates and acts, but the management organization does. This means that the responsibility to confirm the work performed and the responsibility for the result should lie with the contractor.
Pakhomov added that the committee supports this logic and consistently enhances transparency in the management of apartment buildings. A law has been passed obliging the Ministry of Construction to approve a list of information in the annual report of management organizations, as well as expanding the possibilities of control by owners.
Andrey Glushkin, a member of the Board of Directors of Merakom Development, founder of Merakom Far East, and a member of the Council of MRO Delovaya Rossiya, said on February 19 that housing and construction cooperatives (HCS) give future owners the opportunity to directly participate in the construction of a house and control key decisions. According to him, unlike the classic equity scheme, where the buyer has virtually no influence on the choice of materials, contractors and design solutions, in HBC, shareholders approve estimates and contractors at a general meeting.
