Families of victims of child substitution in Primorye will appeal to the Supreme Court

The Semenov and Moskalkov families, whose sons were replaced in the hospital of the city of Lesozavodsk, Primorsky Krai, intend to appeal to the Supreme Court of Russia. This was announced on February 23 by the victims' lawyer, Alexander Zorin.

"We have received the decision of the cassation instance. We will appeal to the Supreme Court of Russia on February 25," he told TASS.

The courts refused to pay compensation to Sergey Stepanov and Andrey Moskalkov for a medical error in a Soviet maternity hospital, citing the absence of a corresponding law before 1991.

The substitution of children occurred in 1989 — the mothers brought children with the same tags, and the mistake went unnoticed for a long time. Zorin told Izvestia on January 26 that the refusal of the courts to provide compensation violates the principle of equality and child care, since it is necessary to take into account the time when the harm was done, and not the moment when the mistake was made.
