Insurers complained about the collection of excess payments on CTP

Many insurance companies have recently been faced with collecting CTP payments in excess of the limit for hardware. This problem especially affects those insurers who have difficulties with the organization of repairs at the technical station in the direction. This is stated in a statement by the Russian Union of Motor Insurers (RSA), which was received by Izvestia on February 16.

According to representatives of the RSA, payments that are assigned by court decisions exceed the limit set by the CTP law for property payments (400 thousand rubles). There are no provisions in the law that would prescribe to insurers how to act correctly if repairs are impossible or have failed.

Representatives of the union indicated that they are discussing with the Bank of Russia, government officials and insurers changes to legislation that will contribute to the development of a more understandable mechanism of action for each of the parties.: both in the case of repairs, and if there is only a payment

"If there are more such payments, and we see that judicial practice is still moving in this direction, then, on the one hand, consumers will be able to receive more in some cases, but on the other hand, this will inevitably negatively affect all policyholders in the future," the union experts said and clarified that the increase in payments will lead to to an increase in the cost of the mandatory "motor vehicle".

Earlier, on February 2, it was reported that State Duma deputies had prepared an inter-factional bill, which proposes to oblige insurance companies to make recourse claims against the perpetrators of accidents in the presence of aggravating circumstances.

The deputies also proposed to link the rate of tariff increases for CTP policies to an increase in the average salary in the region. According to parliamentarians, this measure will eliminate cases of a sharp increase in tariffs across the region.
