Migrants will be denied the grant or renewal of a patent if income data has not been submitted to the Federal Tax Service or wages are below the subsistence level. Such a bill was approved by the Cabinet of Ministers. A residence permit or temporary residence permit will be revoked if a foreigner has worked in the Russian Federation for less than ten months during the reporting year or his family's income is insufficient, taking into account all household members. What restrictions are imposed

New conditions for obtaining and extending patents are going to be introduced for migrants. The government commission on legislative activity approved the package of measures developed by the Ministry of Finance on Monday, February 9. The lack of data on earnings in the Federal Tax Service system or income below the subsistence level will become a direct basis for revoking a patent, temporary residence permit or residence permit, Vladimir Gruzdev, Chairman of the Board of the Russian Bar Association, told Izvestia.

"This is an effective tool to combat shadow employment and fictitious paperwork," he said.

In particular, restrictions may apply to those whose income falls below the established minimum subsistence level for all dependents. A special formula for calculating will include a regional coefficient. The patent will also not be renewed if during the reporting period, that is, during the year, its holder worked for only ten months or less.

Information on the income of foreigners will be transmitted by the tax authorities to the Ministry of Internal Affairs through a single system of interdepartmental electronic interaction. The new rules will not apply to the initial patent application.

Another innovation, according to Vladimir Gruzdev, will be the regulation of the stay of minor migrant children in the country.

For each child, it will be necessary to pay an additional fixed advance payment on personal income tax, — said Vladimir Gruzdev.

He added that upon reaching the age of 18, the children of foreigners will be required either to leave the Russian Federation within 30 days, or to issue their own patent for the full cost.

— The bill regulates a fixed advance payment on personal income tax for migrants, — added the Chairman of the Board of the AYR. — The requirement to pay this payment applies not only to patent employees, but also to foreigners temporarily or permanently residing in the Russian Federation who work for individuals.

As Vladimir Gruzdev noted, the project is aimed at improving the legal regulation in the field of labor activity of foreign citizens in Russia.

Consequences of stricter rules for migrants

Tax authorities are required to provide information on migrants' incomes to the Ministry of Internal Affairs in accordance with the action plan for the implementation of the Concept of the State Migration Policy of the Russian Federation for 2026-2030. Mikhail Burda, head of the Migration department at the Center for Scientific and Research Expert Support of Projects Contributing to the Achievement of National Development Goals at the Presidential Academy (RANEPA), reminded Izvestia about this.

This is done automatically, based on employers' reports on insurance premiums, and is an effective mechanism for suppressing fictitious employment.

"This is aimed at whitewashing the part of the Russian foreign labor market that works on patents, that is, about 2.3 million people (in 2025)," he said. — Foreigners often work without an employment contract. This makes it possible to implement various schemes to avoid taxation both on the part of the migrant and his direct employer.

The proposed measures are one of the significant steps towards the transformation of Russian migration policy towards increasing the effectiveness of control over foreign citizens, the grounds for their stay in Russia, as well as the decriminalization of the labor market for foreign workers, Mikhail Burda believes.

— In addition, this is one of the steps towards the formation of a unified information system for the exchange of data on foreign citizens between Russian regulatory and law enforcement agencies. This practice should only be welcomed," the expert noted.

The introduction of strict income requirements for migrants is associated with a number of potential negative consequences, including the risks of mass withdrawal into the shadows, said Vladimir Kuznetsov, chairman of the All-Russian Trade Union of Mediators.

"The tightening of legal mechanisms of stay and employment may push some migrants, especially those who cannot confirm sufficient official income, to search for illegal ways of earning money and illegally staying in the country," he believes. — And this can lead to the growth of the shadow economy and complicate the control of migration flows.

The new rules may also create significant difficulties for family migrants, especially for those who have several dependents, the expert believes. The requirement to confirm the cost of living for each family member may be too much for many, which will lead to the separation of families or their forced departure from Russia.

The main purpose of the innovations is to ensure that foreign citizens staying in Russia are able to provide for themselves and their families on their own, without creating an additional burden on the social system of the state, the lawyer added. However, stricter migration legislation may lead to a reduction in the number of foreign workers in the sectors of the economy where they are traditionally employed, which will lead to a shortage of workers and higher costs for employers.

Nevertheless, the requirement to confirm official income encourages foreign citizens to legalize their earnings and pay taxes, Vladimir Kuznetsov noted. And setting higher criteria for financial viability can help improve the quality of migration by attracting more qualified and economically active people to Russia who are able to successfully integrate into society.

According to experts, it is important to find a balance between the need for control and ensuring a humane approach to foreign citizens, especially those who are already integrated into Russian society and live with their families in the country.
