Russia may tighten requirements for advertising on cars

A bill has been submitted to the State Duma, which proposes to clarify and expand the current ban on the use of vehicles as advertising structures. The document was published on February 5 on the website of the lower house of Parliament.

Changes are planned to be made to the law "On Advertising". The current version of the law prohibits the use of cars exclusively or primarily as mobile advertising structures, including the conversion of car bodies for these purposes. The bill proposes to exclude the term "mobile" from it.

"The condition that a vehicle loses its basic functions is excluded, which makes it possible to recognize as a violation any situation when it is used primarily for advertising. It is also clarified that the ban covers not only mobile, but also static advertising on transport. In addition, it is explicitly stated that making the body look like a product is considered a form of making changes to the design that is prohibited," the authors explained in an explanatory note.

It is also proposed to increase administrative fines for violations of the requirements. According to the document, they should be from 10 to 40 thousand rubles for citizens, and from 50 to 100 thousand rubles for officials. Currently, according to Part 2 of Article 14.38 of the Administrative Code of the Russian Federation, fines range from 3 to 5 thousand rubles for citizens, from 30 to 50 thousand rubles for officials and from 500 thousand to 1 million rubles for legal entities.

The deputies explained that the so-called "billboards on wheels" (structures on car trailers) are increasingly found on city streets and parking lots. They can remain stationary for a long time and actually represent uncoordinated stationary advertising media that distort the appearance of the urban environment, the document says.

On February 2, it was reported that the bill, which proposes to tighten administrative responsibility for the operation of vehicles with modified (emergency) headlights, did not reach the first hearing. The relevant Committee of the State Duma decided to return it to the author in order to comply with the requirements of the Constitution of the Russian Federation and the regulations of the State Duma.
