Sergei Gavrilov, chairman of the State Duma Committee on Property, Land and Property Relations, told Izvestia that in 2026, according to the government's plan, Rosreestr is working on amendments to the law on horticulture, which should change two narrow but painful places: the rules on the boundaries of the farming co-op territory and the procedure for registration of common property. According to him, it is precisely because of common things ‑ roads, driveways, places for containers, platforms, electricity lines, pipes and other networks — that horticultural associations most often have disputes about who is responsible for the road, who pays for repairs, whether it is possible to put up a barrier and how to legally lay a cable.

The first change concerns the boundaries of the farming co-op territory: when creating a partnership, its boundaries should not include plots of people who were not founders, except in some cases with the land of the state or municipality. In the projected scheme, it is proposed to leave this ban for new farming co-ops, and for existing territories to add the opportunity to expand borders at the expense of a "foreign" site only with the written consent of its owner.

"Without the consent of a person, his plot will not be "recorded" in the territory of a farming co—op, but where the owner himself wants to be inside the common territory, the partnership will have a legal way to formalize it," the Izvestia interlocutor emphasized.

Gavrilov added that another innovation will be related to the common property of farming co-ops: roads, driveways, playgrounds, places for garbage, as well as networks and plots of general-purpose land. Now, according to the law, this should belong to the owners of the plots in common ownership, but in practice, registration often stalls due to the need to collect decisions, prepare a cadastre and then register the right. In the model under discussion, they want to simplify the moment of the emergence of the right by linking it to the registration of common property on cadastral registration.: as soon as a common object is registered, the owners of the plots have the right to common ownership without a long chain of additional steps.

He stressed that the plans specify the time frame for submitting the draft to the government in the spring and submitting it to the State Duma towards the end of the year, and before that, the current rules continue to apply to farmers.

Earlier it became known that in March, the government is going to submit to the State Duma a bill to simplify the registration of rights to common property of summer residents, as well as the annexation of other territories. This is indicated in the government's legislative activity plan for 2026.
