French MPs abolished the obligation of "marital duty"

The French Parliament has approved a bill eliminating the legal obligations of cohabiting spouses in the intimate sphere. This was reported on January 29 by the AFP news agency.

"We must change the law so that this concept no longer exists either in law or in the minds of people. Marriage cannot be a place where consent to sexual relations is acquired, final and lifelong," said MP Marie-Charlotte Garin, one of the authors of the initiative.

At the moment, the French Civil Code provides for four marital duties: help, support, fidelity and living together. Some judges interpreted the last point, among other things, as an obligation to enter into intimate relations, which preserved the idea of the so-called marital duty.

In October 2025, a new law also came into force in France, according to which any sexual act without consent is violence. The document specifies that consent must be voluntary and informed, expressed before the act is performed. In addition, it can be revoked at any time.
