The lawyer warned about the risks of incorrect comments on bank transfers

Often the reason for blocking bank cards is the wording in the purpose of the payment. For personal transfers, it is better not to leave comments at all or use neutral messages. This was announced to Izvestia on January 29 by Sofya Lukinova, head of the Legal department of VMT Consult.

When paying for goods and services, on the contrary, it is recommended to specify the specific purpose of the payment, since in this case it is assumed that an electronic receipt will be received from an individual entrepreneur, an organization, or a self-employed person. The expert also advises avoiding ambiguous expressions and obscure abbreviations and being prepared to document the operation.

"If you need to transfer a large amount, although you usually do not do this, we advise you to contact the bank and notify the organization in advance about the transfer. If the operation is atypical, the transfer may be blocked as part of the fight against fraudsters," explained Lukinova.

She recalled that in accordance with Federal Law No. 115-FZ, banks are required to monitor customer transactions, and special attention is paid to card-to-card transfers. The purpose of payment analysis is used to identify possible illegal activities or attempts to hide income from taxation.

According to the lawyer, suspicion may be aroused by comments like "for rent," "for an apartment," "for ordering," "thank you for your help," or specifying a specific product — in some cases, this may be regarded as receiving unofficial income from commercial activities.

Separately, Lukinova drew attention to the transfers "for debts." If funds are received irregularly and from a limited number of people, the system usually does not respond. However, frequent transfers marked "repayment of debt" or "interest" from different senders over a long period of time may attract the attention of bank control and lead to questions about possible illegal banking activities.

In addition, the lawyer added that a bank lock can be challenged by contacting a credit institution directly and requesting an official comment on the reasons for the restrictions on the card. After that, the client must provide supporting documents — checks, receipts, correspondence or other evidence of the legality of the transactions.

"If this does not help, a person has the right to apply to the Interdepartmental Commission (IAC) at the Bank of Russia. The Commission provides a response within 20 days (usually faster). In case of a positive decision, the bank is obliged to remove the block. As a last resort, you can take the bank's actions to court," the expert concluded.

On the same day, Alexander Khaminsky, head of the Law Enforcement Center in Moscow and the Moscow Region, said that most banking applications allow you to add a short comment when transferring from card to card. However, some formulations may cause the operation to be blocked.

On January 10, Yuri Mirzoev, CEO of Mitra National Law Company, warned about the risks of transferring money to a card. He clarified that regular receipts from legal entities or sole proprietors may indicate hidden labor relations or entrepreneurial activity.
