An employee has the right to use up to two hours of the working day for a lunch break, but this time is not included in the working day. This was announced on January 26 by Alexander Khaminsky, head of the Law Enforcement Center in Moscow and the Moscow Region.
"An employee can spend from 30 minutes to two hours on lunch," the lawyer told RIA Novosti.
He noted that the duration of the break is determined by the rules of the internal labor regulations and is not paid by the employer.
Earlier, on January 18, it was reported that ignoring the established lunch break and continuing to work contrary to the rules or the employer's order may result in disciplinary action. Lawyers pointed out that refusing to eat was not in itself a violation, but failure to comply with the rest regime could be considered a violation of labor discipline. It was also emphasized that an employee does not have the right to voluntarily leave work earlier, referring to an unused lunch break.
