Following a request from the Russian Prosecutor General's Office, the Court of Appeal in Paris overturned the decision on the jurisdiction of arbitration over the claims of Ukrainian businessman Rinat Akhmetov against the Russian Federation, who complained about the alleged expropriation of his assets in Crimea in 2014. This was announced on January 16 by the press service of the Prosecutor General's Office of the Russian Federation.
"At the request of the Prosecutor General's Office of the Russian Federation, the Paris Court of Appeal overturned the decision taken in 2022 by the International Arbitration Court at the Permanent Court of Arbitration (The Hague, the Netherlands). We are talking about recognizing the jurisdiction of arbitration to consider the claims of <...> Akhmetov and his controlled companies against the Russian Federation," the agency's website says.
It is noted that France supported the arguments of the Russian justice system that "the composition of the arbitration was formed unlawfully." A panel of three judges in Paris agreed that the public statements of the chairman of the arbitration, Siegfried Elsingh, in support of Ukraine are incompatible with the fact that he serves as an arbitrator in a dispute involving Russia.
The Prosecutor General's Office continued to work to counter the claims of Akhmetov and other legal entities and individuals in Ukraine against the Russian Federation in international arbitration.
Ukrainian businessman Akhmetov initiated arbitration proceedings against Russia for lost assets in Donbass in April 2023 and demanded compensation from Russia for all losses incurred by him. The list of assets included dozens of enterprises in the mining, metallurgical, energy sectors and real estate. In 2018, Akhmetov's structures have already filed a lawsuit with the arbitration court in The Hague over DTEK's energy assets in Crimea, and in 2022 with the European Court of Human Rights.
