The lawyer explained the eviction procedure by the Valley bailiffs
Lawyer Alexander Khaminsky spoke about the procedure by which bailiffs will act if singer Larisa Dolina does not voluntarily hand over the keys to the apartment in Khamovniki to Polina Lurie.
In conversation with aif.ru On Thursday, January 14, the expert noted that at this stage the debtor is given a second deadline for the voluntary execution of the judgment: if the first opportunity was ignored, enforcement proceedings are opened, and the debtor has five days to comply with the court's requirements.
Khaminsky clarified that the countdown for this period begins from the moment the notification is sent. Thanks to the Gosuslugi and Gospost services, such messages arrive almost instantly, so Dolina's absence cannot be considered a valid reason for delaying the execution of the decision, since she is aware of judicial acts and her duties.
The lawyer also explained the enforcement procedure: in the presence of witnesses, bailiffs open the apartment, take the remaining items to a temporary storage warehouse and draw up an act of transferring housing to a new owner.
At the same time, Lurie's presence at the autopsy is not necessary, since she is not a debtor in the case — she will be invited only to arrange the transfer of real estate, if desired, with the participation of a lawyer. The police are not required, since bailiffs have the necessary powers.
