The expert spoke about the possibility of taking a vacation after the New Year holidays

Citizens of the Russian Federation have the opportunity to take a vacation immediately after the end of the New Year holidays, however, this requires prior approval from the employer and timely entry of the appropriate date into the approved vacation schedule. This was announced on December 31 by Petr Petkilev, Associate Professor of the Department of Civil Law and Procedure and Private International Law at the RUDN Law Institute.

"The Labor Code does not restrict an employee from going on vacation immediately after the New Year holidays. But it is necessary to take into account several nuances. The necessary vacation dates must be included in the vacation schedule in advance. It is approved by the employer no later than two weeks before the beginning of the year. Such a schedule, by virtue of the direct instructions of the law (Article 123 of the Labor Code of the Russian Federation), is mandatory for both the employer and the employee," he said in an interview with RIA Novosti.

Petkilev explained that the employee has the right to use the full vacation period, which, as a rule, is 28 calendar days. The exercise of this right is possible subject to coordination with the immediate supervisor and prior entry of relevant information into the vacation schedule.

The expert also stressed that the right to annual paid leave arises after six months of continuous work in the organization. However, by mutual agreement with the employer, it is allowed to provide paid leave before the expiration of the specified period.

The school management fears that it will be necessary to recover the funds paid for the rest if the teacher does not work for a year.

HR specialist Zulia Loikova said on December 8 that in order to increase the amount of vacation payments, it is better to go on vacation in months with a large number of working days. In 2026, such months are April, July, September, October and December. It was clarified that it is recommended to take vacations precisely in those months when the number of working days is maximum in order to increase the amount of vacation payments in 2026.
