Alexander Khaminsky, a lawyer and head of the Law Enforcement Center in Moscow and the Moscow Region, told how Larisa Dolina would be evicted from her apartment in Khamovniki.

"I don't see any chance of Dolina winning the trial. Therefore, when the decision comes into legal force, the person concerned — the party to the case (Lurie) — will hand over the writ of execution to the bailiffs. The bailiffs will initiate enforcement proceedings, offer the debtor to execute the judicial act on a voluntary basis, and give him several days to do so. In case of refusal, the court's decision will be enforced: the door will be opened and evicted," Khaminsky explained in an interview with aif.ru on Wednesday, December 24th.

The lawyer expressed confidence that Dolina would not interfere with the execution of the court's decision. According to him, otherwise it will entail serious image losses, as the forced eviction will become public and will be shown throughout the country.

Earlier on December 24, the Supreme Court confirmed that the lower courts had made a mistake when they took away Polina Lurie's apartment without compensation at the request of singer Larisa Dolina. The verdict emphasized that even if there were all the formal conditions for challenging the deal, the courts were obliged to apply the principle of bilateral restitution. 360.ru .

On December 23, Sergey Zhorin, chairman of the bar Association, said that Larisa Dolina has the right to file a lawsuit for the protection of honor and dignity because of the label "Dolina scheme". He explained that to do this, it is necessary to find out who first publicly uttered this phrase, as well as to prove its negative connotation. kp.ru .

Also on December 23, lawyer Nina Yeremenko allowed Dolina to win in the Moscow City Court. According to her, a repeated psychological and psychiatric examination confirmed that at the time of the transaction Dolina was in a state of stress, fear and delusion. However, the fact of the new study indicates that the court intends to seriously review the circumstances of the case, and not just formally approve the previous decision, writes RT.

On December 22, Sergey Zhorin explained that Dolina has the right to take legal action against sellers on marketplaces who use her images without consent. In accordance with Article 152.1 of the Civil Code of the Russian Federation, the artist can seek the removal of photographs, the seizure of goods — such as masks — as well as the recovery of compensation for moral damage, clarifies Life.ru . Zhorin warned that the compensation amounts in Russia are modest. Courts rarely award more than 100 thousand rubles, more often — 30-50 thousand rubles.

On December 16, the Supreme Court recognized Polina Lurie's ownership of the Dolina apartment. On December 25, the Moscow City Court will consider a lawsuit for the artist's eviction.
