Alexander Khaminsky, a lawyer and head of the Law Enforcement Center in Moscow and the Moscow Region, assessed Larisa Dolina's chances of collecting additional rent from Polina Lurie.
In conversation with aif.ru On Thursday, December 18, he indicated that the prospects for this were extremely limited, since the deal had not been concluded at a clearly undervalued price. According to him, participants in civil turnover have the right to independently determine the terms of the transaction, and the basis for a different court decision could only be a bonded transaction in which the value would differ significantly — several times — from the market. In this case, there was a voluntary expression of the seller's will when setting the initial price of 130 million rubles, as well as reasonable and reasonable bargaining.
The lawyer stressed that all these circumstances are reflected in the decision of the Khamovnichesky court, where arguments concerning the cost of housing were considered in detail during the meetings. He also explained that the apartment needed expensive repairs, as the interior was outdated and did not meet modern requirements, which was discussed by the parties. Taking into account the urgency of the sale and the cost of housing renovation, the parties concluded that the price of 112 million rubles is reasonable.
In addition, Khaminsky pointed out that the case file contains the conclusion of the state forensic examination of the Ministry of Justice, according to which the market value of the apartment at the time of the transaction — on June 20, 2024 — was 138 million rubles, with a cadastral value of 123 million rubles.

At the same time, the claim for invalidation of the purchase and sale transaction has been sent for reconsideration to the Moscow City Court. The ownership of the apartment in Khamovniki is still assigned to Lurie, and Dolina is allowed to live in the disputed housing until a decision is made by the court of appeal, writes NSN.
If she does not vacate the apartment voluntarily, an eviction lawsuit will be filed. Lurie's lawyer Svetlana Sviridenko expressed the hope that such measures would not have to be resorted to.
