Illegal extension threatens to collapse the house on Sadovnicheskaya embankment

The complicated story of an illegal and dangerous extension that threatens to collapse an entire house is being considered in the Zamoskvoretsky Court of Moscow. Residents of the capital's high-rise building claim that their signatures on the document approving the construction were forged. The details of the high-profile case on December 9 are told by Izvestia.

The collective action was signed by 50 owners of the capital's residential complex. They demand to demolish the illegal extension, which puts pressure on the foundation and threatens the integrity of the house.

"The plaintiffs have a trump card — the previous decision of the Meshchansky court. The reconstruction permit, which was issued to the owner of the extension by the Moscow Housing Inspectorate, was actually declared invalid," said correspondent Kirill Olkov.

The extension, installed in circumvention of the law, was established by the court, belongs to the owner of the apartment on the first floor, Nadezhda Domokurova. She went to expand at the expense of other owners — she affected the facade, which is a communal property. This can only be built with the written consent of everyone. But according to the owners, it was forged.

"The residents claim that the consent was fabricated. About 60 or even 70 people signed the statement," lawyer Oleg Sukhanov said.

In the minutes of the general meeting, 167 owners allegedly spoke in favor of the extension. However, as it turned out, the majority of those interviewed by Izvestia had not heard of any voting at all. The residents found out about the results of the meeting by chance from a house chat. There are other people's autographs in front of their names in the scanned protocol. Moreover, many of them are not just dissimilar, but have nothing in common with the original.

"It's not my signature, I didn't put it on, they didn't even bother to sign it somehow. There is a suspicion that the Criminal Code helped this situation," suggested Olga Koksenkova, a resident of the high—rise building.

The house on Sadovnicheskaya Embankment is managed by the State Service company. Its CEO, Sergey Yudin, claims that he himself allegedly sees these essentially fake documents for the first time. However, even if this is the case, it does not remove responsibility from the management company. She was obliged to request the documents from the owner and double-check their authenticity.

"The management company must monitor what is happening in her house, she must react. Perhaps there is some kind of negligence here," said Svetlana Razvorotneva, Deputy Chairman of the State Duma Committee on Construction and Housing and Communal Services.

Sergei Yudin's previous management company, State – LTD., was already involved in a similar scandal at the Literator residential complex. There, as on Sadovnicheskaya Street, the owner was given permission for an extension — no one asked the tenants. The court eventually decided to demolish it.

The initiator of the scandalous document collection in the house on Sadovnicheskaya Street is Domokurova, who built the canopy. But she does not want to comment on the suspicion of forgery of documents.

"Here I see signs of the crime of forgery of documents. If the decision of the meeting is invalid, then all the reconstruction work carried out will be illegal," said Susana Kirakosyan, Deputy Chairman of the Committee of the Chamber of Commerce and Industry of the Russian Federation on Entrepreneurship in the housing and Communal Services sector.

After the Meshchansky court annulled the Moscow Housing Inspectorate's permit for the extension, the owners of the residential complex had essentially two questions: when it would be demolished and who would answer for forgery of documents, which became the starting point for illegal expansion.

It is unknown how the illegal extension will affect the house in the future. The weight of the roof exceeds 30 tons, this is reflected in the documents of the Meshchansky court. There was no such additional load in the house project.

"In our history, there have already been the collapse of stairwell spans — the collapse of buildings, cracks in the floors that endangered people's health due to improper redevelopment and reconstruction," said Konstantin Krokhin, chairman of the Board of the Union of Housing Organizations of Moscow.

In September, the press service of the Russian Ministry of Construction told Izvestia that the construction or reconstruction of buildings and structures without obtaining a construction permit is unacceptable. Such real estate objects may be recognized as unauthorized buildings in accordance with the legislation of the Russian Federation.
