The employer has the right to require the employee to return from vacation ahead of schedule only in really urgent cases. Anna Alikova, an independent HR expert, told Izvestia on December 8.

"Such situations include, for example, accidents or the need to perform critical tasks that cannot be solved without the participation of this employee," she said, stressing that any such requirements must be officially justified and documented.

However, the specialist drew attention to the fact that an employee may not leave the holiday ahead of time if the reason for the call does not look convincing. According to her, the employer must clearly explain the need for the employee's presence, otherwise the company risks facing legal problems, including possible compensation and claims from the supervisory authorities.

If an employee is not ready to go to work ahead of time, the expert recommends that they calmly notify the employer of their disagreement and refer to the terms of the employment contract.

"In most cases, the rules for summoning from vacation are the same for all types of employment contracts. However, if the contract is concluded for a certain period of time, the conditions may be more stringent," concluded Alikova.

On November 17, the State Duma proposed not to include weekends in the number of days of paid leave. It is specified that currently the mandatory annual vacation period of at least 14 consecutive days includes weekends.
