The case with Apartment Dolina: new details of the high-profile story
The story of the sale of the luxury apartment of the People's Artist of Russia Larisa Dolina has taken a new turn. The buyer of the property, entrepreneur Polina Lurie, filed a complaint with the Supreme Court, and also paid property tax for the disputed apartment, the transaction for which was declared invalid. This move was another episode in the litigation, which has been going on for more than a year. For more information, see the Izvestia article.
A new stage in the case of the Dolina apartment
Having lost both her money and her apartment, Polina Lurie filed a complaint with the Supreme Court of the Russian Federation. The case file on the court's website states that the complaint has been registered. Experts note that the outcome of the complaint will be important not only for the parties to the conflict, but also for the formation of judicial practice in similar cases. The trial is scheduled for December 16.
Lurie's lawyer Svetlana Sviridenko confirmed the filing of the complaint. She also said that her client had to pay personal property tax for the disputed apartment, in which she did not actually live. The amount exceeded 100 thousand rubles. According to Sviridenko, the Federal Tax Service (FTS) issued a demand to Lurie, despite the fact that the transaction was declared invalid and the ownership was revoked.
However, as Alexander Yakubovsky, a State Duma deputy and member of the Committee on Construction and Housing and Communal Services, explained to RT, invalidating the transaction during the period of disputed ownership does not automatically entail an automatic refund of the paid property tax. He also noted that this fact alone does not change the legal assessment of the transaction, since paying the tax is the responsibility of the person to whom the ownership right was registered during the reporting period.
Thus, paying the tax has become an additional burden for Polina Lurie as part of the ongoing dispute.
What caused the conflict?
The high-profile court case is based on a complex fraudulent scheme. In April 2024, fraudsters contacted the singer, posing as intelligence officers, and reported that some intruders wanted to steal her savings from the bank, as well as take loans in her name secured by an apartment in the capital's Khamovniki district.
After that, she was invited to take part in a "special operation to catch fraudsters," warning her "about responsibility for disclosing information to other persons." The actress was convinced that the sale of housing would be fictitious. After the deal was concluded, Dolina transferred some of the funds to supposedly secure accounts, and transferred some of them in cash to the courier.
Polina Lurie, an entrepreneur from Moscow, bought the singer's apartment. In May 2024, the parties signed a purchase and sale agreement. The transaction amount amounted to 112 million rubles and was registered in the Federal Register. However, soon the scammers told Dolina that a deposit had been issued for her country house. Then the People's Artist suspected that she had been deceived and contacted the police. Later, she said that she began receiving threats.
Initiation of proceedings and court decisions
A criminal case was opened on this fact under the article "Fraud". Four defendants were detained in the case: Dmitry Leontiev, Angela Tsyrulnikova, Artur Kamenetsky and Andrey Osnovy. At the end of November, the Balashikha Court of the Moscow region found them guilty of fraud on an especially large scale. They were sentenced to four to seven years in prison.
Realizing that she had become a victim of deception, Larisa Dolina also filed a lawsuit to invalidate the transaction and return the apartment. Polina Lurie, in turn, filed a counterclaim for the singer's eviction, insisting on her status as a bona fide acquirer. She indicated that she had personally communicated with Dolina before the transaction, checked all the documents and acted within the law.
However, the courts of three instances — the Khamovnichesky District Court of Moscow, the Moscow City Court and the Second Court of Cassation of General Jurisdiction — took a unified position. They admitted that pressure had been put on the singer. The purchase and sale agreement was declared invalid, and ownership of the apartment was returned to the Dolina family, including her daughter and granddaughter.
Today, the case with the apartment of the People's Artist has gone beyond the usual legal dispute and has given rise to a discussion in the legal community and the media, conventionally called the Valley effect. We are talking about a precedent when the seller of an apartment tries to challenge the deal shortly after its sale, claiming that he has become a victim of fraud, and a bona fide buyer is left with nothing.
The personal drama associated with the apartment overlapped with the singer's long-standing family experiences. At the end of September, she revealed the details of the serious illness of her only daughter, Angelina. According to Dolina, Angelina was diagnosed with hemolytic jaundice at birth. This disease is fraught with serious complications, including the risk of developing kidney failure and chronic gallbladder problems.
