Starting in 2026, new owners of land for individual and garden houses in the Moscow region will receive an urban development plan for the land plot. If the requirements of the GPZU are not met, the house will not be registered. In this case, according to MP Gennady Panin, the court will force the housing to comply with urban planning standards. Such a bill was adopted by the State Duma in the first reading. Experts believe that the initiative will reduce the "gray" patterns of land use. For more information, see the Izvestia article.

The essence of the bill

Yesterday, on December 3, the State Duma adopted in the first reading a bill on conducting an experiment in the construction and reconstruction of individual residential and garden houses in the Moscow Region.

According to the document, owners of land plots who have received rights to them since January 1, 2026, will be given an urban development plan for the land plot. It outlines the maximum parameters of permitted construction. After the construction is completed, the cadastral engineer must check whether the standards have been met. If they are violated, the specialist will not give the owner the technical plan that is needed to register the built housing.

There are more than 2.5 million individual residential houses and garden houses in the Moscow region, more than 12.3 thousand farming co-ops, 3 thousand cottage settlements located on land plots for individual housing construction (IHS) and gardening, the explanatory note says.

What are the norms in the GPZU and how can housing be registered?

The GPZU contains parameters for construction:

— the minimum distance of houses from the boundaries of land plots is 3 m

— the maximum percentage of development within the boundaries of the land plot is 40% of the plot

— the maximum number of floors or height of buildings.

These norms have already been legally fixed, and the owners could have received the GPP earlier, but upon application.

Today, the owners of houses can register them by notification — the owner must coordinate the house plan with the authorities, and in a simplified (dacha amnesty) — the owner registers the property by sending the authorities a minimum of documents.

"This is when, without asking anyone, I built what I wanted on my site, without looking into the current legislation, rules and regulations. You can violate spatial characteristics, margins, and then, in fact, register it according to the declaration, which you filled out yourself as best you could," said Sergey Pakhomov, co—author of the bill, head of the State Duma Committee on Construction and Housing and Communal Services.

The explanatory note to the document says that every year the rights to more than 80 thousand residential and garden houses are registered, about 90% of them — according to a simplified procedure.

As the co-author of the bill, State Duma deputy Gennady Panin, explained in a conversation with Izvestia, if the document is adopted, from 2026, all country houses in the Moscow Region should be built taking into account urban planning standards, regardless of the registration procedure.

— We assume that if the house is not being built according to the GPP, the court will force the housing to comply with urban planning standards, — said Panin.

Registering a house on a residential housing estate site is the only way to secure your rights, Valery Tumin, director of the Russian and CIS Markets at fam Properties, told Izvestia. According to him, the house does not legally exist until it is entered into the USRN: it cannot be sold, donated, bequeathed to heirs, used as collateral for a loan, it cannot be registered at the place of residence and gas is carried out.

— If an emergency occurs, such as a fire or flood, you will not receive compensation from the state. When the land is seized for state use, the same thing happens. Plus, the owner pays an increased tax, because the land is formally used for other purposes," Tumin said.
According to lawyer, real estate expert and realtor Vadim Handomoinikov, from March 1, 2025, living in an unregistered house is a violation. New homes need to be registered immediately. Now this is a mandatory procedure for operation, and failure to register can result in a fine.

Why do we need innovations?

The law is needed so that "settlements do not turn into chaotic buildings in violation of urban planning norms and rules."

The government of the Moscow region receives more than 1,000 complaints a year from residents about violations of fire and urban planning regulations due to non-compliance with the requirements of the GPP, the explanatory note says.

As stated in a post on Pakhomov's Telegram channel, due to the registration of housing according to a simplified procedure in which "no one checks anything," there are "neighborhood wars," problems with travel, violations of the requirements of insolation, there is no "uniformity in the appearance of at least the main street." In some cases, according to the deputy, a large metal hangar appears in a row of residential buildings on the street, similar to a store or a car repair shop, but registered under the dacha amnesty as an apartment building.

"Any simple path is good to a certain extent. There is a problem that needs to be solved. In short, we suggest timely informing the new owners that the territory has rules and requirements that must be observed. And if you do not comply with them, then there will be difficulties in registering a new building. And these requirements are not new, as they have already been established," wrote Pakhomov.

Tumin supports the bill. He believes that because of the construction, disputes with neighbors occur, the Federal Register refuses to register, and in the worst case, the house is demolished through the courts. According to him, there are more than 40 thousand such problematic objects in Russia.

— Today, there is widespread unregistered houses, abandoned plots, and misuse of land, for example, commerce on residential housing plots. With such changes to the Urban Planning Code, lawmakers are solving several tasks: tightening control, reducing "gray" schemes for the use of facilities, and moving to transparent transactions. As a result, there is a replenishment of budget revenues from property taxes and the general civility of the market," Handmoynikov comments to Izvestia.
