Decorating an entrance for the New Year holidays can result in administrative liability for residents if fire safety requirements and rules for the use of communal property are violated. Ilya Vasilchuk, a judicial lawyer, an expert on the security of electronic transactions and real estate transactions, and a public figure, told Izvestia on December 3.

According to him, according to the decree of the Government of the Russian Federation No. 1479, stairwells, corridors and platforms belong to escape routes and must remain free of objects that impede movement or contribute to the spread of fire.

"It is forbidden to place decorations that may interfere with emergency evacuation or create a fire threat," the specialist explained.

The lawyer recalled that the entrances are the common property of the tenants under art. 36 of the Housing Code of the Russian Federation. The installation of a Christmas tree, garlands or other decorative elements requires the consent of all owners and coordination with the management company. At the same time, he noted that holding such a meeting could be an occasion to unite neighbors and avoid conflicts: the decision to decorate the house would be made collectively and without mutual claims.

However, if the rules are violated, liability becomes unavoidable. Vasilchuk said that fines are provided for non—compliance with fire safety requirements: for citizens — from 5,000 to 15,000 rubles, for officials — from 20,000 to 30,000 rubles, and for organizations - from 300,000 to 400,000 rubles (Article 20.4 of the Administrative Code of the Russian Federation). In case of damage to common property, for example due to a faulty garland, Article 7.21 of the Administrative Code of the Russian Federation with a sanction from 1 thousand to 1.5 thousand rubles may be applied.

"If the garland causes a fire, flooding or damage to the common property, the owner is obliged to compensate for the damage. And if the violation caused serious harm to health or death of a person, then, according to Article 219 of the Criminal Code of the Russian Federation, criminal liability is possible — up to seven years in prison," the expert concluded.
