Bona fide buyers in the Russian Federation were offered to reimburse funds for the seizure of apartments

On December 2, the Russian Guild of Realtors (RGR) proposed to create a mechanism for state compensation for the seizure of an apartment from a bona fide buyer in case the transaction is declared invalid.

"To create an additional system of financial compensation for a bona fide buyer in case the transaction is declared invalid under Articles 177-179 of the Civil Code (CC) of the Russian Federation and the apartment is seized by way of bilateral restitution," the RGR's message reports TASS.

It clarifies that if the seller does not have the money to return the funds to the buyer, the state can provide a preferential loan secured by the apartment, which will be returned to the seller, but with the subsequent possibility of its transfer to state ownership and the conclusion of a social rental agreement for the seller without the right to privatize.

The guild added that under such an initiative, the original mortgage collateral may be retained, in particular, the seller, who was able to cancel the transaction, assumes obligations to repay the loan on the original terms. In addition, this mechanism allows you to release the buyer from the debt burden and ensure that the dispute is settled fairly, without violating the "stability of civil turnover."

Vladimir Koshelev, first deputy chairman of the State Duma Committee on Construction and Housing and Communal Services, said on November 30 that Russia could introduce a mechanism for securing real estate in transactions to protect buyers from fraudulent schemes. According to him, the property will remain in a secured condition with the buyer until a full refund for its purchase in case of cancellation of the transaction by court decision.

Prior to that, on November 22, the press service of the Fair Russia faction reported that a legislative initiative was being prepared in Russia to combat fraudulent schemes for the sale of apartments, known as the "Babushkin scheme." The authors of the document will be party chairman Sergei Mironov and Deputy Chairman of the State Duma Committee on Economic Policy Mikhail Delyagin.

On November 24, State Duma deputies Sergey Kolunov and Ilya Wolfson prepared initiatives aimed at combating fraud in real estate transactions, especially involving senior citizens. We are talking about more than 3,000 cancelled transactions involving pensioners, which, according to them, has become widespread. It was noted that socially vulnerable citizens, including participants in the special operation (SVO) and single mothers, are among the victims.
