You weren't standing here: fraudsters illegally issued parking privileges
MOORE's detectives detained members of a criminal group who illegally issued parking privileges for cars of persons unrelated to the privilege. An employee of a leather dispensary participated in the scheme, supplying personal data of people with disabilities. The arrests took place in Moscow with the military support of the Russian Guard. They closed the shop
The arrests took place simultaneously at several addresses in Moscow and the Moscow region. According to the investigation, five people were involved in the scheme. Joseph A. was responsible for the selection of performers, coordination of actions and distribution of money. The banking details of the relative of the alleged leader of the group, Raisa A., received funds obtained by criminal means.
Mikhail S., according to the operatives, supervised the work of the group and registered accounts of disabled people on the Gosuslugi portal, and then entered information about vehicles on their behalf to receive benefits.
Another actor was Yulia G., a resident of Solnechnogorsk. Using her official position (she worked as an administrator at a skin and venereological dispensary and social service), she supplied Mikhail with personal data of disabled people.
Ufa resident Marcel N. worked with clients. In his testimony, he confirmed that he collected payments from interested parties and handed over the license plates of their cars to accomplices for inclusion in the registers of carriers of disabled people.
During the searches, physical evidence was seized: a laptop with an extensive database, four mobile phones, bank cards issued to front persons, as well as a large amount of money — 150 thousand rubles and almost $ 3 thousand.
According to the investigation, the group is involved in at least 30 episodes of criminal activity.
By which article to judge
According to lawyer Pavel Korniako, the actions of the suspects should be qualified under articles on forgery and the use of knowingly forged documents.
— The actions of the accomplices of the scheme are provided for in Part 4 of Article 327 of the Criminal Code of the Russian Federation, are punishable by imprisonment for a term of two to six years with a fine of up to 500 thousand rubles or in the amount of wages or other income of the convicted person for a period of up to three years or without it and with restriction of liberty for up to one year or without it.
For those who bought fake permits, liability is provided under Part 5 of the same article for the use of a deliberately forged document.
— Is punishable by a fine of up to 80 thousand rubles, and mandatory correctional labor is also provided. The most severe punishment is arrest for up to six months.
Since the actions are classified as a minor crime, the lawyer predicts a lenient punishment for all participants in the case.
— Most likely, the story will end with a suspended sentence or a fine for the purchasers of such documents. For sellers, the same "conditionality" and a fine.
In his opinion, it will not be easy to get a guilty verdict in court.
— In terms of proving guilt and collecting evidence, this case is quite difficult, the process can take a long time, — says Korniako. — So long that the statute of limitations for these crimes, classified as minor, will expire.
However, the interlocutor suggested that the actions of the official involved in the criminal case may be additionally qualified under the article on forgery or abuse of official authority.
Lawyer Ekaterina Krasnova does not rule out that the alleged accomplices may also be charged with an article on the illegal collection of personal data.
— If the investigation finds out that the attackers, without the knowledge of the disabled, used their accounts in state services and performed manipulations, then such actions immediately fall under several articles from the chapter of the Criminal Code on crimes in the field of computer information.
They trade via messenger
Izvestia found a Telegram channel (the data is available in the editorial office), where users are offered to purchase discounted parking.
"There is a large influx of customers due to the November discount, but we are coping with everything! The speed of adding to the registry remains unchanged, a maximum of a day!" the post says. Intermediaries who supply clients are promised generous rewards. In the next message, "proof" is a notification about the posting of information about a vehicle allegedly from the Pension and Social Insurance Fund. It is possible that this channel was created by simple scammers who are pulling money from simpletons, but the resource has a significant number of subscribers. Administrators ask for 3 thousand rubles for the test period, and 22 thousand rubles for the year. They promise an indefinite certificate for 36 thousand rubles.
How to buy a benefit
A disability benefit opens up a number of privileges for the driver. If a disabled person or an accompanying person has a special sign and the car is entered in a special register, they are exempt from paying for parking in the capital region in places with appropriate markings, and they are compensated for the cost of CTP. There are also a number of traffic restrictions for the disabled.
— In fact, buyers of such benefits pose as drivers with disabilities of group I or II or drivers of children with disabilities, - says lawyer Ekaterina Krasnova. — But citizens should understand that they are complicit in illegal actions. You will have to bear responsibility, not only criminally, but also financially. Government officials may well file a lawsuit on behalf of the city to a person who is illegally using the benefit.
