Buying an apartment on the secondary market is increasingly causing concern among buyers, as the risk of a subsequent dispute over the transaction has increased significantly. A study conducted by experts of the construction and investment corporation Development-Yug showed that almost half of the participants, at the slightest threat of disruption of the transaction, prefer to abandon the "secondary" and pay attention to new buildings. The results of the study were reviewed by Izvestia on November 26.

"Recently, the number of claims from sellers of retirement age has increased to challenge transactions. To minimize the risks, it is necessary to carefully check the seller's legal capacity. The basis for challenging such transactions is that at the time of the conclusion of the purchase agreement, the seller was not aware of the nature of his actions and could not direct them," said PhD, Managing Partner of Barrister Law Firm. & Barrister Vladimir Zavyalov.

In simple words, the person was in a state of passion, frustration, or other mental state that influenced the decision, and under normal conditions he would not have made the deal.

The lawyer explained that before buying, it is necessary to assess the seller's condition, including whether there is a record in a drug treatment or psychiatric clinic, since such circumstances become grounds for rejecting the transaction.

According to the expert, psychological assessment also plays an important role: a specialist must determine whether a person understands the significance of their actions, is aware of the consequences, is able to make decisions freely and consciously, is not under stress or confusion, and correctly assesses the situation. Zavyalov emphasized that the psychologist records whether there is increased suggestibility or individual characteristics that can affect behavior and cause a distortion of ideas about the transaction.

He added that in some cases, it is advisable for the buyer to contact a notary public to conduct a forensic examination, since the expert is warned of criminal liability for false conclusions, which gives his conclusions significant weight in the case of court proceedings.

Fear of fraudulent schemes leads Russians to prefer more predictable and legally protected new buildings, even if they have to wait for construction to be completed. In a survey conducted by Development-Yug, it turned out that if a retirement-age seller suddenly refuses a deal, 49.6% of respondents consider it right to choose a new building right away. Attempts to convince the seller, according to 7.2% of respondents, look ineffective, and contacting the police, which 16.8% would choose, also does not guarantee a solution to the problem. Almost a third of the study participants, 26.4%, admitted that they are afraid of litigation, since the risk of losing both money and housing remains too high.

Analysts of Grad Development said on November 14 that the average cost of 1 sq.m. The cost of housing in Moscow in October ranged from 400,000 to 1.9 million rubles. The highest average cost per square meter has traditionally been noted in the Central Administrative District of the capital (1.93 million rubles). The second place is occupied by the Western District (CJSC) (700 thousand rubles).
