The temporary freezing of buyer's funds when making real estate transactions can reduce the risks of fraud and abuse in the secondary housing market. Alexey Lossan, an analyst at the financial marketplace Compare, told Izvestia on November 25.
"The proposed measures to protect real estate buyers, such as delayed cash withdrawals, mandatory psychiatric examination of sellers and the expansion of the areas of responsibility of notaries and realtors, are generally a sound idea. They are aimed at creating an additional barrier for unreliable participants in the transaction, which significantly limits the opportunities for fraud and abuse in the purchase and sale of housing," the expert said.
According to him, the market without such tools remains vulnerable to schemes in which sellers — often elderly people — can be subjected to pressure or manipulation, and after receiving money, try to challenge the deal, seeking to return the apartment. This leads to situations where buyers risk losing both funds and housing at the same time. The expert stressed that stricter controls increase the transparency of the process and reduce legal risks.
"Stricter controls increase the transparency and responsibility of all participants in transactions and reduce legal risks. For example, the expansion of notary liability and property rights insurance act as additional guarantees that can protect the interests of bona fide buyers. This can reduce the likelihood of financial losses and litigation," Lossan concluded.
On the same day, Sergei Mironov, chairman of the Fair Russia Party, submitted amendments to the law "On State Registration of Real Estate" to the State Duma, providing for a "seven—day cooling-off period" - a temporary freeze of buyer's funds when making real estate transactions. It is assumed that during this time the seller will evaluate his actions, and if he realizes that he is under the influence of fraudsters, he will be able to refuse to sell housing.
