The court has put an end to the case of an extension to an elite high-rise building in Moscow

On November 24, the Meshchansky Court of Moscow declared illegal an extension and a permit for its construction in an elite high-rise building in the center of Moscow. Now the residents want to find out who forged their signatures and achieve the demolition of the terrace that is destroying their house.

The decision was made in record time. The Meshchansky court needed to hold only three sessions.

"The court has heard our arguments. There were indeed serious violations at the design and approval stage," said Oleg Sukhanov, a lawyer and representative of the owner.

The owner of the apartment on the ground floor, Nadezhda Domokurova, decided to increase its area and added a part of the facade, which belongs to all residents. They tried to convince Domokurova to stop the work, but she ignored their requests.

According to an independent expert assessment, the total weight of the extension was more than 30 tons, which was not included in the project. In addition, experts noted that the Moscow Housing Inspectorate can only issue permits for redevelopment, and not a full-fledged reconstruction.

"The law says: when alienating common property, the consent of every single shareholder is required. Even if you have one square meter and if you disagree, no one can do it without you," said Alexander Tolmachev, Doctor of Law, member of the Committee of the Chamber of Commerce and Industry of the Russian Federation on Entrepreneurship in housing and Communal services.

At the same time, Domokurova has the minutes of the general meeting, at which 167 owners allegedly voted for the extension. However, the residents claim that their signatures were forged.

The State Service management company, which maintains the house, only promises to figure everything out. According to Sergey Yudin, general director of the management company, the assistants ensured that there was no encroachment on communal property.

Yudin's statement contradicts the court's decision. It was the seizure of communal property by the owner of the extension that became one of the arguments for revoking the decision of the Moscow Housing Inspectorate.

State Service has long been associated with the developer of the house, Gals-Development. Yudin's previous company, State Ltd., operated another Galsa complex, Literator, whose owners have been suing for eight years.
