Noise during the day or at night remains one of the most frequent causes of conflicts between neighbors. According to the law, residents can be held accountable not only for night parties or repairs at the wrong time, but also for exceeding the permissible noise level from ordinary household appliances. What to do if neighbors make noise, where to contact in such cases, and what are the penalties for violating silence in 2025, Izvestia reports.

What is considered noise by law

The legislation classifies a wide range of sounds as disturbing the peace. The violation of the peace and quiet of citizens is not only understood as loud music or shouting. These include playing musical instruments, singing, using pyrotechnic devices, as well as any other loud sounds produced at night.

According to SanPiN, the permissible noise level in residential areas is 40 dBA during the day and up to 30 dBA at night. For territories directly adjacent to residential buildings, the daily norm is slightly higher — 55 dBA.

However, there are situations where the "laws of silence" do not apply. In such cases, noise is acceptable at night. These include:

  • elimination of consequences of accidents and emergencies;
  • noise in the process of crime prevention;
  • natural disaster management;
  • noise in new buildings in the first year and a half after the house was put into operation;
  • some rituals and ceremonies held on religious holidays;
  • cultural events with the permission of the authorities, such as New Year's Eve.

The list of actions recognized as a violation may be clarified and expanded at the level of the subjects of the Russian Federation. This means that in different regions of the country, noisy activities may include, for example, moving furniture, using a vacuum cleaner or washing machine, crying a child, and even barking a dog.

Renovation work and "quiet hour"

Special attention in the legislation is paid to the regulation of noise associated with the reconstruction and renovation of premises. These jobs often cause trouble to the neighbors. As a rule, renovation work in apartment buildings is allowed.:

  • on weekdays — from 09:00 to 19:00, but with a mandatory break for a "quiet hour" from 13:00 to 15:00;

  • on weekends and holidays, such work is often completely prohibited. In some regions, they are allowed in an abbreviated mode.

Legislation on silence in 2025

Currently, there is no single federal "law on silence" in Russia. The main document regulating these issues remains Federal Law No. 52-FZ "On the sanitary and Epidemiological welfare of the population." He delegates the authority to set the time limits for night time and rules for observing silence to regional authorities.

A draft federal law on silence is currently under consideration in the State Duma. Its goal is to introduce uniform rules for the whole country, Evgeny Masharov, a member of the commission of the Public Chamber of Russia for the public examination of draft laws and other regulations, recalled in August 2025.

He clarified that the draft proposes to introduce the following restrictions::

  • noise ban from 23:00 to 07:00;
  • introduction of the daytime "quiet hour" from 13:00 to 15:00;
  • The time limit for repairs is from 09:00 to 19:00 on weekdays.

The bill is currently under discussion, so residents should be guided by current regional regulations.

The regime of silence in the regions of Russia

  • Moscow. In the capital, night time is considered to be the period from 23:00 to 07:00. Additionally, there is a day break on weekdays from 13:00 to 15:00, during which any noisy activities are prohibited, with the exception of certain types of work that this restriction does not apply to.

  • Moscow oblast. The noise ban is valid from 21:00 to 08:00 on weekdays and from 22:00 to 10:00 on weekends and holidays. There is also a "quiet hour" from 13:00 to 15:00 everywhere.

  • Saint-Petersburg. The following time limits are set for the northern capital: from 22:00 to 08:00 and with a break from 13:00 to 15:00 on weekdays, as well as from 22:00 to 12:00 on weekends and holidays.

How to measure the noise level in an apartment

To officially prove a violation of silence, measurements carried out by an accredited laboratory with the preparation of an appropriate protocol are required. However, you can also take preliminary measurements yourself in order to objectively assess the situation and justify your position when filing a complaint.

To measure the noise, you will need:

  • a noise meter conforming to GOST, which can be purchased at electronics stores or online;
  • a smartphone with a special application for measuring the sound level in decibels (dBA), for example SmarterNoise. The results will be less accurate than those of a professional device, but they will be quite suitable for an overall assessment.

How to measure noise

To carry out the measurement, it is necessary to tightly close all windows and doors in the room where the measurement is performed, and place the device or smartphone at least 1 m away from the walls, ceiling and floor, approximately at the level of a person's head in a standing position.

If the noise is heard regularly, it is recommended to keep a measurement log or take screenshots in the application, where the date, time and noise level are visible. It is also good to make a video where the device screen with readings will be visible and the noise source will be heard.

Where to contact if the neighbors are noisy

If peace negotiations with troublemakers are unsuccessful, citizens have the right to appeal to various authorities to protect their rights.

Where to file a complaint

  • To the management company (CC). If the noise is constant (for example, daily repairs), you should send a written complaint to the Criminal Code. The management company is obliged to verify the fact of the violation and issue an order.

  • To Rospotrebnadzor. This service is authorized to measure the noise level using special equipment. An expert opinion on exceeding the permissible threshold will become strong evidence in court.

  • The precinct officer. In case of persistent violations, a written request can also be sent to the district commissioner for a preventive conversation.

  • To the police. If there is prolonged night noise, a police squad should be called. Employees are required to arrive on call, record the violation and draw up a report on an administrative offense.

  • File a statement of claim in court. In the case of systematic violations that have caused moral harm (for example, chronic lack of sleep, stress), the injured party has the right to apply to the court with a claim for compensation.

In order for complaints to be effective, it is recommended to collect evidence: make audio and video recordings, record the time and duration of the noise, save copies of appeals to official authorities and involve other affected neighbors for collective appeals.

Fines for violating silence in 2025

Administrative responsibility for violation of silence is provided for by the Code of Administrative Offenses of the Russian Federation (Code of Administrative Offenses of the Russian Federation). The amount of the fine varies depending on the status of the offender and the severity of the offense, and is also regulated by regional codes.

So, Muscovites will have to pay from 1,000 to 2,000 rubles. In St. Petersburg, for household noise at night and other "noisy" actions, citizens receive a warning or fine in the amount of 500 to 5,000 rubles.

For officials and legal entities, this amount is much higher and can reach up to 200 thousand rubles.
