How does CTP work in case of an accident
The CTP policy is designed to protect the financial interests of road users in the event of accidents. This type of insurance does not cover the car itself, but the driver's civil liability. If all the participants in the accident have CTP, the injured party will receive compensation from the insurance company of the culprit. This applies to both car repairs and personal injury compensation.
CTP covers damage to any property, not just vehicles. For example, if a road sign, fence, or bus shelter was damaged as a result of an accident, the insurance company of the culprit will compensate the city services for the cost of replacing them.
Conditions for receiving CTP payments
To receive CTP payments, three basic conditions must be met simultaneously:
- the driver is the injured party in an accident;
- the incident was officially recorded by traffic police officers or issued according to the European protocol.;
- the culprit of the accident has a valid CTP policy.
In the case of mutual guilt, both drivers are recognized as both culprits and victims and can expect to receive payments. If the degree of guilt of each participant is determined by the traffic police or the court, it will be taken into account when distributing compensation. When the degree of fault is not established, each driver receives 50% of the damage amount.
The amount of CTP payments in case of an accident
Current legislation sets limits on the amount of CTP payments. These limits are the maximum and cannot be exceeded under any circumstances.
The insurance indemnity is:
- up to 400 thousand rubles — for damage to property (car, bus stops, lights, etc.);
- up to 500 thousand rubles — for harm to life and health.
When registering an accident according to the European protocol, insurance companies compensate exclusively for car repair costs. The amount of compensation directly depends on the compliance of the accident participants with the established procedures.
The maximum payout of 400 thousand rubles can be received if:
- the participants in the accident reached an agreement on the circumstances of the accident;
- A complete list of vehicle damages has been compiled;
- an accident notification has been issued in paper or electronic form;
- The scene was photographed.
If there is disagreement between the participants in the accident, the maximum amount of payment is 200 thousand rubles. In such a situation, the insurance company has to independently determine the culprit of the incident based on the submitted materials.
If the drivers registered an accident according to the European protocol, but did not take a photo, the amount of compensation will not exceed 100 thousand rubles. This limitation is due to the need for additional checks on the circumstances of the incident.
If it is impossible to identify the culprit unambiguously, the insurance companies can divide the compensation equally among all participants in the accident. The total amount of payments in this situation does not exceed 200 thousand rubles for two drivers.
How to get the maximum CTP payout in case of an accident
Strict adherence to the sequence of actions after a traffic accident allows you to receive the required insurance payment in a timely manner. Proper behavior at the accident site greatly simplifies subsequent interaction with the insurance company.
The algorithm of actions in case of an accident:
- Immediately report the incident to the traffic police and your insurance company.;
- Complete all necessary documents at the accident site.;
- Carefully check the correctness of the protocol and the scheme of the accident.;
- Get an official accident report;
- Prepare a complete package of documents for the insurance company;
- Apply for an insurance payment within the prescribed time frame.;
- Provide a vehicle for inspection and damage assessment;
- Wait for the insurance company's decision to pay compensation.
To receive an insurance payment, you must prepare a specific set of documents. Their full list may vary depending on the specific circumstances of the accident.
Basic documents for an insurance company:
- claim for damages;
- traffic police protocol or notification of an accident according to the European protocol;
- passport and driver's license;
- documents on the ownership of the vehicle;
- bank details for transferring funds;
- materials of photo and video recording of the scene;
- written testimony of accident witnesses;
- medical documents (if there were any casualties).
The insurance claim must be submitted within five business days from the date of the accident. This can be done in person, through a representative, or by sending the documents by registered mail.
Terms of CTP review and payment
The standard period for reviewing documents is 20 business days from the date of receipt of the full package. This period is the same for all insurers, but it can be extended if there are disputes. During this period, the insurance company is obliged to make a decision on compensation or refusal.
In case of violation of the established deadlines, the insurance company is obliged to pay a penalty in the amount of 1% of the payment amount for each day of delay. This measure protects the rights of victims and encourages insurers to meet their obligations on time.
If the driver personally came to the office of the insurance company, the employee is obliged to check his documents on the same day and either accept them or indicate the need to supplement the information about the accident. In the case of electronic submission of documents, the insurer must confirm their receipt within a few minutes. Over the next two business days, the company must check the completeness of the documents and, if necessary, request additional materials.
