A pensioner pushed a girl on the way to the Moscow metro: what is known
On Monday, November 10, it became known that on the eve of the day at the Taganskaya station of the Moscow metro, "on the basis of a sudden personal hostility," a woman born in 1961 from Krasnodar pushed a 13-year-old girl onto a hard track (rails). This was reported by the press service of the Main Investigative Department of the Investigative Committee of the Russian Federation for the city of Moscow.
The official representative of the Ministry of Internal Affairs of Russia, Irina Volk, wrote in the Telegram channel: "It is important to note that the incident occurred just before the train arrived at the station with the contact rail turned on."
The incident occurred after a woman made a remark to a teenager about talking too loudly, to which the girl did not respond. After that, the pensioner pushed the child. Fortunately, the tragedy was avoided. The video from the subway cameras shows the moment of the girl's fall and how she was helped to get out before the arrival of the approaching train.
The pensioner herself stated during the interrogation: "There was a girl standing next to me, laughing loudly and looking at me. I considered it a personal insult and wanted to physically hurt her. I pushed her and she jumped onto the tracks. I stood there and saw them taking her out."

The criminal case: what could threaten a pensioner?
According to the latest information, the Investigative Committee's department for the investigation of crimes on the subway, high-security facilities and in the environmental sphere has opened a criminal case under Part 3 of art. 30 and Part 1 of art. 105 of the Criminal Code ("Attempted murder"). The pensioner has been detained, and the investigation intends to request her detention.
Sean Betrozov, a lawyer for the Moscow Chamber of Lawyers and a member of the Russian Bar Association, told Izvestia about what the woman could face for the incident in the subway.
According to him, a committed (completed) murder under Part 1 of Article 105 of the Criminal Code is punishable by 6 to 15 years in prison. In case of an attempt, the law lowers the upper limit of punishment. In practice, this means that the sentence will be less than for a completed murder, but it will remain real and substantial.
— The court will take into account the pensioner's age, state of health, behavior after the incident, admission of guilt and other circumstances. But the fact that death did not occur does not make the act any less dangerous. Pushing into the path of the subway poses an obvious deadly risk. Plus, there may be claims for compensation for moral damage and medical expenses for the girl, which can reach several million rubles," the lawyer believes.
The expert also explained why the investigation considered the incident an attempted murder, and not an "ordinary quarrel." A contact rail runs along the tracks, which is under high voltage, and the time interval between the arrival of trains is short. Thus, a fall on the way can immediately lead to the death of a person.
— A deliberate push on the way is recognized as a desire to harm health or cause death. Even if the conflict started because of a domestic reason, the legal assessment is based on the situation and the consequences that were barely avoided, explains Sean Betrozov.
It is also important to take into account the girl's age, the lawyer notes. According to him, if it is proved that the woman understood that in front of her was a child under the age of 14, the qualification will include a sign of "attempted murder of a minor." This is the more serious part of Article 105 of the Criminal Code of the Russian Federation.
During the investigative measures, says Sean Betrozov, video experts will analyze where the woman pushed the child from and how, whether there was an effort with her hands, a step forward, a jerk, in which direction the girl flew away and how close to the edge the participants were standing, how much time remained before the arrival of the train, and whether there was a chance to retreat or hold the person.
— The reaction of the one who pushed after the committed act is also important. Whether the woman pulled the child back, called for help, or, conversely, moved away. Investigators will compare the recordings from different cameras and witness statements. If, taken together, it is clear that the action led to the death of the child, this obviously constitutes an intent to take life," the expert believes.
The age of the woman is also important, the lawyer notes. According to him, the pensioner should be sent for a psychological and psychiatric examination, as this directly affects the outcome of the case.
— Psychiatric examination is carried out in case of doubts about sanity. Experts must answer two questions: whether the woman understood the nature and danger of her actions and whether she could direct her behavior. If so, she is sane and carries the usual criminal liability. If not, the court may apply compulsory treatment in a specialized institution. There are also intermediate cases when there is a diagnosis, but it does not remove responsibility, but is taken into account as an extenuating circumstance," concludes Sean Betrozov.
What to do if someone falls on the subway tracks
The metro is a convenient and popular means of transportation in a big city, but you need to be especially careful and know the rules that will help save lives.
According to the recommendations of the metro, in case you fall on the rails, in no case should you attempt to get out on the platform yourself.
If the approaching train is not visible, you need to quickly walk towards the tunnel as the train is moving, avoiding the edge of the platform. Next, you need to stand behind the black-and-white rail, where the train usually stops, and wait for the metro staff to help.
If the train is already close, you need to lie face down in the tray between the rails. The head should be directed towards the moving train. Don't move. This position should be maintained until assistance is provided.
If another person has fallen on the rails, you do not need to help him out on your own. It is necessary to contact a metro employee or call for help through an emergency call column.
If there is enough time before the train arrives, you need to go to the stop area of the last car, stand at the boundary line and wave your hand in a circle — the driver will thus understand about the person on the way.
