The State Duma proposed to introduce liability for erroneous traffic fines

Deputies have submitted to the State Duma a bill that proposes to introduce administrative liability for officials for illegal fines for car owners. The document was posted on October 31 in the database of the lower house of parliament.

The draft law proposes to amend the Administrative Code of the Russian Federation by supplementing Chapter 12 with a new article 12.35.1, which provides for administrative liability of officials for illegally bringing the owner (owner) of a vehicle to administrative responsibility by imposing an administrative fine. Its amount should be the same as the issued illegal fine, but not less than 5 thousand rubles.

The authors of the bill explained that drivers often face receiving fines for traffic violations that have not been committed. At the same time, in the materials accompanied by the ruling, it is clear in the photos from the photo-video complexes that the motorist is actually innocent. For example, someone else's car got into the photo; it was not the car that crossed the solid marking line, but its shadow; a speeding ticket was issued for the car that was on the tow truck at that moment.

"However, even with such obvious signs of the absence of an administrative offense, officials inadvertently, in a hurry or deliberately sign resolutions on administrative offenses, probably believing that only a few drivers will appeal them," the explanatory note says.

It is noted that a small number of all administrative fines issued are currently being appealed, since it is often easier for a driver to pay such a fine than to waste time and effort on proceedings.

Earlier that day, the State Duma (proposed to introduce a discount on gasoline for citizens who had not been held accountable for traffic violations during the month and were not the culprits of the accident. With such an initiative, Deputy Speaker of the State Duma Boris Chernyshov (LDPR) appealed to the Minister of Energy of the Russian Federation Sergey Tsivilev and the head of the State Traffic Inspectorate Mikhail Chernikov.
