Cars under customs procedures may be exempt from recycling

The State Duma proposed to exempt vehicles placed under the customs procedures of a customs warehouse, a free warehouse, as well as processing in the customs territory and imported into the Russian Federation from paying the recycling fee. The bill was submitted to the lower house of Parliament on October 28.

It is proposed to amend Article 241 of the Federal Law "On Production and Consumption Waste". It sets out a list of grounds that exclude the need to pay a salvage fee. However, among the exceptions, the specifics of the application of various customs procedures for imported foreign goods defined by the EAEU Customs Code are not taken into account, the explanatory note says.

In particular, the customs procedure of a customs warehouse provides for the possibility of importing foreign goods that are stored in a customs warehouse for a certain period of time without paying import customs duties and taxes. As a result, companies can ensure the availability of stocks of raw materials, necessary spare parts and components without diverting their own funds or attracting credit funds to pay customs duties, the document says.

At the same time, due to the absence of such a procedure in the list of exceptions, its application for the import of cars or chassis is complicated by the need to pay for scrap, which "contradicts the very nature of the need to pay it," since the goods are not in free circulation in the Russian Federation, the authors of the bill said. At the same time, the customs warehouse procedure provides for the possibility of completing it not only by releasing goods for domestic consumption, but also by re-exporting them during re-export. However, non-refund of paid scrap is not provided in such cases.

The customs procedure for processing in the customs territory provides for the possibility of importing foreign goods without paying import duties and taxes for their processing for subsequent export. The customs procedure of a free warehouse is a symbiosis of the two above-mentioned procedures.
