The Supreme Court of Russia has confirmed the legality of imposing repeated fines for speeding, even if the cameras are located only a few hundred meters from each other. The Supreme Court of Russia has confirmed the legality of imposing repeated fines for speeding, even if the cameras are located only a few hundred meters from each other. The resolution is published on the website of the Supreme Court of the Russian Federation.

The decision was made on a dispute two years ago. A Voronezh-based transport company tried to challenge two similar fines issued by a company bus driver with a difference of just 22 seconds for violations committed on May 4, 2023. It was about the amount of 500 rubles.

According to the cameras, the driver exceeded the speed limit from 60 km/h to 85 km/h, one camera recorded this at 9:07:10, the other at 9:06:48. The employer appealed to the court, appealing that this was a single violation. But the Supreme Court recognized that each of the recorded acts creates an independent composition of an administrative offense and the law is based on separate responsibility.

The resolution stipulates that the frequency of installation of road complexes is fixed in Government Decree No. 754 of 2024.

Such decisions can become a guideline for lower courts.

Lawyer's opinion on double fines

As Sergey Radko, a lawyer for the Freedom of Choice movement, explained to Izvestia, the decision made by the Supreme Court is absolutely legitimate.

— Even if two cameras are literally installed on adjacent poles, these are two different violations, since the actual location of the first and second offenses are different. Thus, the decision made by the Supreme Court is absolutely legitimate. By driving under one speed camera, the driver committed one offense, and by not slowing down in front of the second device, he committed the second one," the expert emphasized.

Sergei Radko also reminded Izvestia in a comment about the government decree that came into force on September 1, 2024, which regulates the installation of cameras for photo and video recording of traffic violations.

The decree prescribes the placement of speed control devices in populated areas at a distance of no closer than 1 km from each other, and on country roads at a distance of at least 5 km from each other.

— However, the same document specifies exceptions to these requirements. For example, on accident-prone sections of highways and intersections where at least four accidents have occurred in a year, cameras can be installed closer to each other," explained Sergey Radko.
